Netflix India has consistently tried to experiment and push boundaries when it comes to original content. While this has mostly been fruitful for the global giant, the same cannot be said for its most recent outings.
Recently, Netflix India has found itself embroiled in a series of legal challenges related to its latest titles like ‘Maharaj’, ‘Tribhuvan Mishra CA Topper’ and ‘IC 814: The Kandahar Hijack’. These back-to-back legal challenges are quite concerning and once again raise issues surrounding creative freedom, censorship, and the broader implications for streaming platforms in India.
These cases also highlight the fact that streaming platforms in India have to face various hurdles due to the continuously increasing scrutiny, many a times followed by legal hurdles. The major reason this happens in our country is because freedom of expression often clashes with cultural, religious and political sensitivities.
Whether it was the ‘Maharaj’ fiasco, the ‘Tribhuvan Mishra CA Topper’ matter or now the ‘IC 814’ row, these all have one thing in common: they supposedly hurt the sentiments of one or the other group of people in the country. So are we as citizens becoming too sensitive or are the propaganda theories real? (Now that’s a question for some other time!)
To remind you, these aren’t the only legal battles Netflix India has faced, there have been cases similar cases before this too for some major titles like ‘Sacred Games’, ‘Leila’, ‘A Suitable Boy’ and more. Ironically all these went on to become super hits and that might be because the buzz was there and even negative marketing is marketing after all.
Anyways coming back to the issue of legal troubles faced by OTTs, in this case Netflix India, and what implications it causes, we cannot deny that in terms of looking at the bigger picture such trends do inhibit creative expression and can lead to a chilling effect on content creation. The producers and writers may find it better to self-censor and avoid potential legal issues.
Moreover, these legal challenges also reflect the unique and sensitive landscape of India. And that’s why it becomes more so crucial for global streamers like Netflix understand and navigate through these sensitivities, not only to avoid legal issues but to also ensure that their content resonates positively with diverse Indian audiences.
But only pointing out the problem won’t help anyone and that’s why we need to look for solutions. The recent spate of legal issues faced by Netflix India for its original content underscores how complexly intertwined are creative freedom and legal accountability in India. And therefore as Netflix India keeps expanding its footprint in the country, it will need to tread carefully, balancing the need to produce compelling, original content with the necessity of adhering to the country’s political, religious and cultural sentiments and frameworks. These cases are nothing less than a reminder of how being a pioneer in the digital content space comes at a cost and isn’t going to be easy, especially in a market as diverse and sensitive as India. The challenges are always going to be there!
